Employing staff for the first time

Q: As a new business I am about to take on my first full time member of staff, what is the minimum I need to do to satisfy employment legislation requirements?

A: I would suggest producing an “Employment Starter Pack” which would include all the necessary documents to engage staff and meet the basic legislative requirements.

  • Offer letter template with specific reference to the Immigration & Asylum Act requirements.
  • Schedule Lists A & B to comply with the Immigration & Asylum Act
  • A Written Statement of Particulars of Employment
  • Disciplinary & Capability Policy & Procedure
  • Grievance Policy & Procedure
  • Holiday/Leave Policy & Procedure
  • Sickness/Absence Policy & Procedure
  • Sickness Self Certification Form.
  • Equal Opportunities Policy (in line with Equality Act 2010)

You might also like to consider the following additional policies and procedures. These are not compulsory as they directly relate to statutory requirements but might help you and your staff understand the obligations and procedures should an issue arise:

  • Maternity and Adoption rights and leave policy & procedure
  • Paternity Leave policy and procedure
  • Parental Leave policy and procedure
  • Flexible Working request procedure

As an employer you must also have:

  • A Health & Safety Policy
  • Carried out a Health & Safety Risk Assessment
  • Carried out a Fire Risk Assessment
  • Employers Liability Insurance
